Welcome to Noardmusic.nl. By creating an account and using this platform, you agree to these Terms of Use. If you do not agree to these Terms, you may not use the platform.
Noardmusic.nl is an online platform where musicians and organizers can create gigs, join gigs, and collaborate on musical projects.
Noardmusic.nl acts solely as a platform and facilitator and is not an employer, booking agency, manager, contractor, or intermediary.
User Accounts
To use Noardmusic.nl, users must create an account and provide accurate and complete information.
Users are responsible for keeping their login information secure and are responsible for all activity under their account.
Users may not share their account with others.
Noardmusic.nl reserves the right to suspend or delete accounts if users violate these Terms or misuse the platform.
Users must be at least 16 years old to use the platform. If a user is under 18, they must have permission from a parent or legal guardian.
User Profiles
Users can create a personal profile containing information such as name, instrument, genre, location, study background, and portfolio materials such as audio, video, or PDF files.
Users are responsible for the information they place on their profile and must not provide false or misleading information or impersonate someone else.
Gigs and Projects
Users can create gigs or projects to find musicians or collaborators.
The user who creates a gig or project is fully responsible for the correctness of all information, including date, location, payment, and project details.
Other users can respond to gigs and contact the gig creator through the platform.
Noardmusic.nl is not involved in agreements between users and is not responsible for the outcome of any collaboration, project, or gig.
Agreements Between Users
All agreements, including payment, rehearsal schedules, performances, cancellations, travel costs, and other arrangements, are strictly between users themselves.
Noardmusic.nl is not a party to any agreement between users and cannot be held responsible for disputes, damages, losses, or conflicts between users.
Payments and Liability
Noardmusic.nl is not responsible for payment issues, cancellations, injuries, damage to instruments or equipment, travel costs, accommodation, project results, or any disputes between users.
Users participate in gigs and collaborations at their own risk.
The platform is provided “as is” without guarantees of availability or error-free operation.
Acceptable Use
Users agree not to post false or misleading gigs, scam or mislead other users, post illegal content, post offensive or discriminatory content, spam other users, upload viruses or harmful software, upload content they do not own or do not have permission to use, or use the platform for illegal activities.
Noardmusic.nl reserves the right to remove content, gigs, messages, files, or accounts that violate these rules.
Content and Copyright
Users retain full ownership of the content they upload, including music, audio files, videos, PDFs, text, and images.
By uploading content to Noardmusic.nl, users grant Noardmusic.nl a non-exclusive license to store, display, and use this content within the platform for the purpose of operating the platform.
Noardmusic.nl does not claim ownership of user content and does not act as a publisher, producer, or distributor of user content.
Users are responsible for ensuring they have the rights to upload and share their content.
Messages and File Sharing
Users can send messages and share files through the platform.
Users are fully responsible for the content of the messages and files they send.
Noardmusic.nl is not responsible for the content of messages sent between users.
Illegal Content and Notice and Takedown
Users are not allowed to upload, post, send, or share content that is illegal, contains pornography involving minors, contains extreme violence, contains discrimination, hate speech, or threats, contains copyrighted material without permission, contains malware or harmful software, violates privacy laws, or is fraudulent or misleading.

Noardmusic.nl is a hosting platform that stores user-generated content. Users are fully responsible for all content they upload, post, or send through the platform.

Noardmusic.nl does not actively monitor all content or messages. However, if Noardmusic.nl becomes aware of illegal content, Noardmusic.nl will act to remove or disable access to that content as soon as possible.

After receiving a report, Noardmusic.nl may:
Remove the content
Suspend or delete the user account
Block access to the platform
Preserve data for legal investigation
Report the content to law enforcement if required by law

Noardmusic.nl is not liable for user-generated content, but will take action when illegal content is reported or detected.

Data Storage and Files
Files shared through messages may be stored temporarily and may be automatically deleted after a certain period, for example after 30 days.
Users are responsible for saving their own files.
Noardmusic.nl is not responsible for loss of files or data.
Privacy and Personal Data
Noardmusic.nl processes personal data in order to operate the platform, such as name, profile information, location, messages, uploaded files, and usage data.
Personal data is processed in accordance with applicable privacy laws including the General Data Protection Regulation (GDPR / AVG).
Users have the right to access, correct, or delete their personal data.

Premium Accounts and Payments
Noardmusic.nl may offer premium subscriptions with additional features such as increased storage, statistics, or additional platform functionality.
Prices, features, and subscription conditions will be clearly communicated.
Users can cancel their premium subscription according to the cancellation terms provided at the time of subscription.
Noardmusic.nl may change pricing or features in the future.
Platform Availability
Noardmusic.nl does not guarantee that the platform will always be available or function without errors.
The platform may be temporarily unavailable due to maintenance or technical issues.
Noardmusic.nl is not liable for any damage caused by temporary unavailability.
Content Moderation
Noardmusic.nl reserves the right to remove content, gigs, messages, or profiles that violate these Terms, are illegal, or are harmful to the platform or its users.
Users can report content or users via the platform or by email.
Account Termination
Users can delete their account at any time.
Noardmusic.nl may suspend or terminate accounts if these Terms are violated, the platform is misused, or if required by law.
Changes to the Agreement
Noardmusic.nl may update these Terms of Use.
Users will be notified of important changes.
Continued use of the platform means the user accepts the updated Terms.
Applicable Law
These Terms of Use are governed by the laws of the Netherlands.
Any disputes will be submitted to the competent court in the Netherlands.
